A legal notice is a formal written communication sent through an advocate, putting the recipient on notice of a grievance and demanding redressal within a stated time. It is the standard first step in most civil disputes — debt recovery, contract breach, tenancy, defamation, and consumer matters.

Important: A legal notice does not stop limitation. The clock keeps running while you wait for a reply — file the suit before limitation expires, even if the notice is unanswered.

When is a legal notice mandatory?

Some statutes make notice a precondition to filing a suit. The most common: Section 80 CPC for suits against the Government, Section 138 of the Negotiable Instruments Act for cheque dishonour, Section 13(2) of the SARFAESI Act for secured-asset enforcement, and most state Rent Control Acts before eviction.

Anatomy of a strong legal notice

  1. Sender details — name and address of the client; the advocate's details and bar registration.
  2. Recipient details — full name and address; getting this wrong invalidates service.
  3. Concise factual narration — dates, transactions, documents, witnesses, in chronological order.
  4. Cause of action — the legal wrong, with statute and section if relevant.
  5. Specific demand — what you want done, in what form, and by when (typically 15–30 days).
  6. Consequence on default — the legal remedy you will pursue (suit, criminal complaint, arbitration).
  7. Signature, date, and dispatch by registered post AD or speed post; keep proof of delivery.

Sample legal notice template (recovery of money)

Warning: Do not bluff in a legal notice. Courts read the notice as the first version of your pleadings — if the demands or facts in it contradict the plaint, the inconsistency will be used against you.

After sending the notice

  • Preserve the notice copy, postal receipt, and acknowledgement card or tracking proof.
  • A reply received from the other side becomes part of the case record — read it carefully.
  • If there is no reply or compliance, file the suit or complaint within limitation.
  • Notice does not stop limitation — the clock keeps running.

A clean, factual, dated legal notice often resolves a dispute without litigation — recipients take a lawyer's letterhead seriously. If you are sending one, make sure the facts and the demand are watertight; courts read the notice as the first version of your pleadings.
